Quebec Residents — Law 25
MicroHabitat (which operates MyUrbanFarm) carries on business in Quebec. Personal information we collect there is governed by the Act respecting the protection of personal information in the private sector, as modernized by Law 25. This section describes our Quebec-specific practices and supplements the rest of this policy.
Person in charge of protecting personal information
We have designated a Privacy Officer responsible for ensuring compliance with Law 25. You can reach them at privacy@microhabitat.ca for any question, access request, or complaint.
Consent
We collect, use, and disclose your personal information with your clear, free, and informed consent, given for specific purposes. We obtain separate consent for sensitive information — for example, photographs of identifiable individuals included in our certification reports. Consent of a person having parental authority is required for information concerning a minor under 14 years of age.
Transfers outside Quebec
We rely on service providers that may store or process personal information outside Quebec, including in the United States (hosting, payment, email, and artificial-intelligence features). Before such a transfer, we conduct a privacy impact assessment (PIA) and frame the transfer with appropriate contractual safeguards.
Automated decision-making
Some features rely on automated processing of personal information (for example, the AI-assisted certification advisor and lead/deal scoring). Where a decision based exclusively on such processing concerns you, you have the right to be informed of it, to know the personal information and principal factors that led to the decision, and to submit observations to a member of our staff who can review the decision.
Your rights
- Access to and rectification of your personal information;
- Withdrawal of your consent at any time;
- Portability — obtaining your computerized information in a structured, commonly used technological format;
- Cessation of dissemination and de-indexing where the law allows;
- Information about automated decisions concerning you.
Confidentiality incidents
We maintain a register of confidentiality incidents. Where an incident presents a risk of serious injury, we promptly notify the Commission d'accès à l'information (CAI) and the affected individuals.
Retention and destruction
We keep your personal information only for as long as necessary to fulfill the purposes for which it was collected; afterward, we destroy or anonymize it in accordance with our retention schedule.
